1. Personal Data

Personal data, also known as personally identifiable information, for purposes of this Privacy Policy means any information that directly and clearly identifies an individual, or can be used in combination with other information to identify an individual. Personal data does not include such information if it is anonymous or if it has been rendered de-identified by removing personal identifiers.
Examples of personal data include: An individual’s name, ID number, home address, home phone number, personal email address, and date of birth.
The group collects and maintains different types of personal data about you in accordance with applicable law.

2. Personal Data Collection

All data provided by the user with the use of the website and/or related services such as inquiries, are provided voluntarily and with the user’s consent and without any legal obligation to provide them. However, in some instances, the personal data the group collects has been inferred about you based on other information you provide us, through your interactions with us, or from third parties.
When we collect your personal data from third parties it is either because you have given us express consent to do so, your consent was implied by your actions, or because you provided explicit consent to the Third-Party to provide the personal data to us. Where permitted or required by applicable law or regulatory requirements, we may collect personal data about you without your knowledge or consent.
The group reserves the right to monitor the use of our equipment, devices, computers, network, applications, software, and similar assets and resources for the safety and protection of our members and intellectual property. In the event such monitoring occurs, it may result in the collection of personal data about you. If required by applicable law, we will notify you of such monitoring and obtain your consent.

3. Rights to Collect Data

The group keeps the right to collect all information that the user provides and/or produces when using the group's services & products, including the types of devices from which the group's services & products are used.

4. Security of Personal Data

We are committed to protecting the security of the personal data collected, and we take reasonable physical, electronic, and administrative safeguards to help protect the data from unauthorised or inappropriate access or use in accordance with the laws of Ohio.

5. Derived Work

A derived work is a work created by fans or users of the site, based on original content created by the group and/or someone on its behalf. These are most commonly known as Fan Art. For musical derivative work, it will be considered as a remix, song cover or adaptation of original musical content created by the group and/or anyone on its behalf.
A derivative work that meets these criterias will not require a prior approval of the group for its making, and we will not exercise the copyright regarding a derivative work that complies with these guidelines.
Creators must take note and avoid creating content that:1. May harm the reputation and image of the group, its talents, the relevant third party or violates its rights2. Interpreted as offensive and/or inappropriate3. Relates to content such as religion, ideology, politics and faith4. Questions the public order and/or morality5. Impersonates official content and/or falsely presented as official, or may be misinterpreted as official6. Intended for commercial purposes or merchandise

6. Usage of Derived Work

The group will have the rights to use derivative works that have been created by fans and/or users for marketing activities, on various platforms such as social media sites, sites for watching and streaming music and video and so on.
The derived work creator is allowed to use their derived work for profit. This only applies if the original works where the copyright belongs to the group and/or anyone on its behalf are not used. We prohibit the registration of a derivative work with a content ID and/or any content identification in any copyright enforcement system.
The group also prohibits the commercialization of such work. Any forms of merchandise or mass-produced items are not allowed without a licensing agreement with the group. We reserve the right to take legal action against any unauthorised commercial usage of its intellectual property.

7. Changes to Terms & Conditions

We may change the terms & conditions at any time without any notice, and it is the responsibility of the user to ensure that he/she is up to date with the latest version of the terms & conditions.

8. Jurisdiction

In the event of a dispute between the user and the group, the terms & conditions in this document/page shall be construed under the laws of Ohio and the courts of Ohio shall have jurisdiction.
In the event of the user’s violation of the terms & conditions, he/she agrees to compensate the group and its employees, directors, shareholders, or anyone acting on their behalf for any damage and loss, loss of profit, payment or expense incurred by them, including but not limited to attorney's fees and legal expenses.

9. Approval of the Terms & Service

The user confirms that they fully understand the terms and conditions in this document/page, and consulted with professionals regarding this matter when necessary, and that they are clear to him/her and that he/she accepts all the terms and service, and that he/she will not have any claims to the group in connection with them.

Be kind and welcoming to new viewers in your stream, other viewers in streams you watch, and also members of Bijou Live.
Please be transparent with information needed or requested for the safety of our group and community.
Please ensure that you do not break Twitch Terms of Service (ToS) while being a part of Bijou Live. You can read details about the ToS here:

If you are unsure whether your behavior would be frowned upon or in violation of the Code of Conduct, or Twitch ToS, don't do it.

2. Integrity

Our reputation as a positive, engaging, and helpful group of the community is our most valuable asset. Please bear in mind that you are representing Bijou Live and it is up to each of us to make sure we continually work to maintain that reputation. Please practice integrity to avoid unnecessary drama with others.

3. Drugs and Alcohol

If you are of legal age to consume alcohol where you reside, feel free to drink alcohol, but please use good judgement and never drink in a way that leads to inappropriate behavior, endangers your life or the safety of others, violates the Code of Conduct, violates ToS, or the law. Even if you reside in a state/country with legal marijuana, please refrain from smoking on stream. Illegal drug use on stream and at Bijou Live events are strictly prohibited.

4. Twitch Terms of Service

You must adhere to Twitch ToS. Failure to do so may not only result in a warning/ban from Twitch, but will also result in a termination of agreement from Bijou Live.

5. Explicit/graphic content

Bijou Live is created to spread love and joy to the general public. To align with our vision, we avoid broadcasting or discussing any overly explicit or graphic content.

6. Harassment/Bullying/Discrimination

Members are expected to create a culture that is free of harassment, intimidation, bias and discrimination. Bijou Live prohibits any form of discrimination, harassment, and bullying - verbal, physical, or visual. If you feel that you have been bullied or harassed by anyone within Bijou Live, immediately reach out to the Group Leader. Members who report a harassment or bullying incident will NOT face retaliation from Bijou Live. If a member is found to engage in harassing, bullying or discriminatory behavior, they will be issued a warning for the first offense. Unless this is a severe incident, for which they will be removed from Bijou Live. On the 2nd offence, the member will be removed from Bijou Live.

7. Conflicts

If an argument escalates to a point of creating actual conflict, the Group Leader will act as mediator.

8. Closing

This Code of Conduct is a dynamic document and may be updated at any time. When revisions are made, the newest version will be published on the Bijou Live Discord server.
